All properties managed or provided by Bondi Living are offered on a furnished basis unless otherwise stated in writing. Furniture, appliances, fixtures, and household items supplied with the premises (“Furnished Items”) are provided for the convenience and use of the tenant or occupant and are supplied in their condition as at the commencement date of the tenancy or occupancy.

Bondi Living will take reasonable steps to ensure that all Furnished Items are clean, safe, and in a reasonable state of repair at the commencement of the tenancy, consistent with the obligations imposed under the Residential Tenancies Act 2010 (NSW).

Except to the extent required by law, Bondi Living makes no representation or warranty regarding the continuing condition, performance, suitability, or uninterrupted availability of any Furnished Items.

Nothing in this disclaimer is intended to exclude, restrict, or modify any rights or remedies that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or under the Residential Tenancies Act 2010 (NSW).

The tenant or occupant agrees to:

  • keep all Furnished Items in a reasonably clean and good condition, allowing for fair wear and tear;
  • promptly notify Bondi Living of any loss, damage, defect, malfunction, or maintenance issue relating to any Furnished Item;
  • not remove, dispose of, alter, replace, or relocate any Furnished Item without the prior written consent of Bondi Living.

An inventory and condition report detailing the Furnished Items will be provided at the commencement of the tenancy in accordance with NSW tenancy requirements. The tenant must review, complete, and return the condition report within the required statutory timeframe and note any discrepancies or concerns.

Bondi Living will arrange for repair or replacement of Furnished Items where required by law, where the item forms part of the landlord’s obligations, or where otherwise agreed under the tenancy agreement. Non-essential Furnished Items may be repaired, substituted, or replaced at the discretion of Bondi Living or the landlord.

To the extent permitted by law, Bondi Living is not liable for any indirect loss, inconvenience, disruption, or temporary reduction in amenity arising from the malfunction, breakdown, repair, replacement, or unavailability of any non-essential Furnished Item.

Bondi Living reserves the right to remove, substitute, or upgrade Furnished Items during the tenancy where reasonably necessary, provided any required notice is given in accordance with applicable NSW legislation.

Personal Property and Insurance

The tenant or occupant is solely responsible for the security, care, and insurance of their own personal belongings and valuables kept at the premises. Bondi Living does not provide insurance coverage for the tenant’s personal property.

Tenants and occupants are strongly encouraged to obtain and maintain appropriate contents insurance or renters’ insurance for their personal belongings, including coverage for loss, theft, accidental damage, or destruction.

To the extent permitted by law, Bondi Living, the landlord, and their agents are not liable for any loss of or damage to the tenant’s or occupant’s personal property, however caused, except where such liability cannot lawfully be excluded.

By entering into the tenancy or occupancy agreement, the tenant acknowledges receipt and acceptance of the Furnished Items as recorded in the condition report, subject always to the tenant’s statutory rights and remedies.
